Terms of Service

By accessing or using the services provided through the Iconwiz platform ("Platform," "Service," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our services.

You warrant that you are at least 18 years old and legally capable of entering into binding contracts. If you are under 18 years old, you warrant that you have obtained consent from your parent or guardian, and they agree to be bound by these Terms on your behalf.

• Service: The Iconwiz website and platform operated at iconwiz.app, including all features, tools, and functionalities provided.
• Content: Any images, icons, or other materials uploaded, generated, or displayed through the Service.
• Generated Content: Icons, images, or other outputs created by our AI services or icon generation tools.
• User Uploads: Original images and content that you upload to the Platform.
• Credits: The virtual currency used within the Platform to access AI generation features.
• Free Credits: Complimentary credits provided upon registration or through promotional campaigns. Free credits never expire but can only be used for AI generation.
• Subscription: A recurring payment plan that grants access to premium features and credits.

Iconwiz is a Software-as-a-Service (SaaS) platform that helps users generate platform-specific icon sets from source images. Our services include:

• Icon generation for multiple platforms (iOS, Android, Web, PWA, macOS, Windows, Electron, Tauri, Flutter, React Native, Godot, Mini-programs)
• AI-powered image generation using third-party AI models
• Image processing with styling options (shapes, backgrounds, shadows, gradients)
• Cloud storage and synchronization for paid subscribers

Third-Party AI Models: Our AI features use third-party models accessed through Replicate, including models from ByteDance (SeedDream), Google (Imagen, NanoBanana), Black Forest Labs (Flux), and others. Iconwiz is an independent service and is not affiliated with, endorsed by, or sponsored by any AI model providers. The availability, quality, and capabilities of AI-generated content may vary and are subject to the limitations of the underlying third-party services.

Content Safety and Moderation: To keep the Service safe and compliant, we may screen prompts, uploads, and generated outputs using automated moderation tools and trusted service providers before or after delivery. We may delay, block, remove, or restrict content, and suspend related activity, when required by law, provider policy, payment-partner rules, or these Terms.

Browser Compatibility: For the best experience, we recommend using modern browsers that meet our minimum version requirements. We recommend Chrome 111+, Firefox 113+, Safari 15.4+, and Edge 111+ for full support of modern web features including OKLCH color space. Older browsers (Chrome 99-110, Firefox 96-112, Safari 16-15.3, Edge 99-110) may display a compatibility notification banner. We do not guarantee full functionality, visual consistency, or optimal experience on browsers below the recommended versions, and these requirements may be adjusted as technology evolves.

4.1 Registration: To access certain features, you must register for an account using a valid email address. You agree to provide accurate information and keep it updated.

4.2 Account Security: You are responsible for safeguarding your password and for all activities under your account. Notify us immediately of any unauthorized access.

4.3 Account Suspension: We may suspend or terminate accounts that violate these Terms, violate our Content Policy, repeatedly or frequently breach our rules, or engage in fraudulent activity. In serious or repeated cases, we may permanently terminate access to the Service.

5.1 Ownership: You retain all rights to the original images you upload. We do not claim ownership of your content.

5.2 License to Us: By uploading content, you grant us a limited license to process and store it solely to provide our services to you.

5.3 Your Responsibilities: You are responsible for ensuring that your uploads:

• Do not infringe on others' copyrights, trademarks, or other rights
• Do not violate any laws
• Do not contain malicious code

5.4 Prohibited Upload Processing and Distribution: You must not upload content that violates our Content Policy, process it through the Service, or distribute any resulting icons, images, files, or other outputs. You are solely responsible for any downstream use or distribution of content derived from your uploads. Any unlawful, infringing, harmful, abusive, sexual, exploitative, or otherwise policy-violating distribution of such results is not endorsed, authorized, controlled, or caused by Iconwiz, is your sole responsibility, and constitutes a serious violation of these Terms.

5.5 Content Removal: We reserve the right to remove content that violates these Terms.

6.1 Your Rights: Upon payment of applicable fees, you receive rights to use the icons and images generated through our Service for any purpose, including commercial use.

6.2 AI-Generated Content: AI-generated images are subject to the terms of the underlying AI model providers. We cannot guarantee exclusive rights to AI-generated outputs, as similar prompts may produce similar results for different users.

6.3 Platform Rights: Iconwiz retains all rights to the Platform itself, including our software, design, and algorithms.

This Section 7 is our "Content Policy." You agree not to use the Service to:

• Generate, request, upload, or distribute illegal, harmful, abusive, defamatory, obscene, or hateful content
• Generate, request, upload, or distribute NSFW, pornographic, sexually explicit, sexually suggestive, nude, or semi-nude content, including suggestive poses, undressing, fetish content, twerking, or any content that exploits, endangers, or sexualizes minors
• Circumvent, disable, probe, or attempt to evade moderation filters, safety classifiers, or account limits
• Infringe on intellectual property rights or generate content that imitates protected works
• Reverse engineer or attempt to extract source code from the Platform
• Interfere with or disrupt the Service
• Use automated tools (bots, scrapers) without written permission
• Share your account credentials with others
• Resell or redistribute access to the Service

We may use automated moderation systems and, where appropriate, human review to enforce this Content Policy and these Terms. We may refuse or fail closed on requests, withhold outputs, remove content, suspend accounts, permanently terminate accounts or access to the Service, and report conduct to service providers, payment partners, or authorities when reasonably necessary or legally required. Violations of this Content Policy, or repeated or frequent violations of these Terms, may result in immediate suspension or permanent termination without refund.

8.1 Plans: We offer subscription plans (monthly/annual) and credit packages. By subscribing, you agree to pay the fees for your selected plan.

8.2 Payment Processing: Payments are processed by Creem (Armitage Labs OÜ). We do not store your payment card details.

8.3 Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date.

8.4 Cancellation: You may cancel anytime through your account settings. You retain access until the end of your billing period.

8.5 Price Changes: We may change prices with reasonable notice. Changes apply to the next billing cycle.

8.6 Taxes: You are responsible for any applicable taxes.

8.7 Grace Period: If your Pro or Premium subscription expires or you downgrade, you receive a 30-day grace period during which your stored materials are preserved. After the grace period, materials exceeding your new plan's limits will be automatically deleted (oldest first). Download any important content before your subscription expires.

8.8 Dynamic Pricing for Flux Models: Flux series models (Flux 2 Dev, Flux 2 Pro, Flux 2 Flex) use dynamic pricing based on reference image size. The additional cost is calculated per megapixel (MP), with total megapixels rounded to the nearest integer (standard rounding: values below .5 round down, values at .5 or above round up). A minimum of 1 MP is charged when any reference images are used. Other models that support reference images do not incur additional reference image costs. The estimated cost is displayed before generation.

9.1 No Refunds: All payments are final and non-refundable. This includes subscription fees, credit purchases, and unused credits. Computing costs are incurred immediately upon AI generation.

9.2 Bonus Credits: Bonus credits are extra credits included with credit package purchases. The bonus percentage increases with larger packages. Active subscribers (Creator, Pro, or higher) receive 20 percentage points more bonus than non-subscribers. For example, if a package offers 35% bonus to subscribers, non-subscribers receive 15% bonus (35% - 20% = 15%). If the subscriber bonus is 20% or less, non-subscribers receive no bonus. The entry-level package (50 credits) does not include any bonus credits for any user. All bonus credits remain in your account permanently and never expire. Bonus credits cannot be converted to cash or transferred.

9.3 Personal Use: Purchased services are for your personal use only. Account sharing and reselling are prohibited and may result in account termination without refund.

10.1 By You: You may delete your account anytime from your account settings. This is permanent and cannot be undone.

10.2 By Us: We may suspend or terminate accounts, including permanently terminating access to the Service, for violations of these Terms, violations of our Content Policy, repeated or frequent violations, fraudulent activity, non-payment, or if required by law.

10.3 Effect: Upon termination:

• Your subscription ends with no refund for remaining time
• Unused credits are forfeited
• Your data is deleted immediately

10.4 Export First: Download any content you want to keep before deleting your account. We cannot recover deleted data.

Our Service uses third-party providers (Cloudflare, Creem, Replicate) that have their own terms and privacy policies. We are not responsible for their services. When you use AI generation, your prompts are processed by third-party AI providers.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT:

• The Service will be uninterrupted or error-free
• AI-generated content will meet your expectations
• Third-party AI services will always be available

Use the Service at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ICONWIZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability shall not exceed the amount you paid us in the 12 months before the claim.

Some jurisdictions don't allow these limitations, so they may not apply to you.

You agree to indemnify and hold Iconwiz harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Content you upload or generate
• Your violation of these Terms or any law
• Your infringement of others' rights

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data. By using the Service, you agree to our Privacy Policy.

These Terms are governed by the laws of the jurisdiction where the Service Provider is established. If any provision is found unenforceable, the remaining provisions remain in effect.

We may update these Terms. For significant changes, we will provide at least 15 days' notice. Continued use after changes means you accept the new Terms.
